{"id":5132,"date":"2022-01-03T10:01:24","date_gmt":"2022-01-03T10:01:24","guid":{"rendered":"http:\/\/www.zenbaki.eus\/?p=5132"},"modified":"2023-08-02T16:13:10","modified_gmt":"2023-08-02T14:13:10","slug":"reforma-laboral-aspectos-mas-importantes","status":"publish","type":"post","link":"https:\/\/zenbaki.eus\/es\/reforma-laboral-aspectos-mas-importantes\/","title":{"rendered":"Reforma Laboral: aspectos m\u00e1s importantes"},"content":{"rendered":"<p>1\u00ba)<strong><span style=\"color: #78be20;\"> TEMPORALIDAD:<\/span> <\/strong>La finalidad de esta nueva normativa es terminar con la contrataci\u00f3n temporal y de hecho, todos los contratos de trabajo se presumir\u00e1n INDEFINIDOS. \u00danicamente habr\u00e1 DOS TIPOS DE CONTRATOS TEMPORALES:<\/p>\n<ul>\n<li>El de sustituci\u00f3n de persona trabajadora<\/li>\n<li>Por circunstancias de la producci\u00f3n.<\/li>\n<\/ul>\n<p>Este \u00faltimo tipo de contrato SOLO se podr\u00e1 utilizar en caso de que la empresa est\u00e9 sufriendo un incremento ocasional e imprevisible en su producci\u00f3n, incluidas las que se producen como consecuencia de las vacaciones anuales y su duraci\u00f3n NO PODR\u00c1 SER SUPERIOR A 6 MESES, PUDIENDOSE AMPLIAR HASTA UN A\u00d1O SI AS\u00cd LO PREV\u00c9 EL CONVENIO COLECTIVO APLICABLE.<\/p>\n<p>2\u00ba) <strong><span style=\"color: #78be20;\">\u00bfQU\u00c9 OCURRE CON LOS CONTRATOS TEMPORALES REALIZADOS ANTES DE LA ENTRADA EN VIGOR DE LA NUEVA NORMATIVA?<\/span><\/strong> Se regir\u00e1n por la legislaci\u00f3n anterior hasta su duraci\u00f3n m\u00e1xima.<\/p>\n<p>3\u00ba) <strong><span style=\"color: #78be20;\">\u00bfPUEDO SEGUIR HACIENDO CONTRATOS DE OBRA O SERVICIO DETERMINADO DESPU\u00c9S DE LA ENTRADA EN VIGOR DE LA NUEVA NORMATIVA?<\/span><\/strong> Si, pero solo hasta el 30 de Marzo de 2022 y su duraci\u00f3n NO PODR\u00c1 SER SUPERIOR A 6 MESES.<\/p>\n<p>4\u00ba) <strong><span style=\"color: #78be20;\">\u00bfQU\u00c9 OCURRE CON LOS CONTRATOS DE PR\u00c1CTICAS REALIZADOS ANTES DE LA ENTRADA EN VIGOR DE LA NUEVA NORMATIVA?<\/span> <\/strong>Se regir\u00e1n por la legislaci\u00f3n anterior hasta su duraci\u00f3n m\u00e1xima.<\/p>\n<p>5\u00ba) <strong><span style=\"color: #78be20;\">\u00bfPUEDO SEGUIR HACIENDO CONTRATOS DE PR\u00c1CTICAS DESPU\u00c9S DE LA ENTRADA EN VIGOR DE LA NUEVA NORMATIVA?<\/span> <\/strong>Si, pero este contrato no podr\u00e1 ser inferior a 6 meses ni superior a un a\u00f1o.<\/p>\n<p>6\u00ba) <strong><span style=\"color: #78be20;\">\u00bfQU\u00c9 SALARIO DEBO PAGAR A UN TRABAJADOR CON CONTRATO DE PR\u00c1CTICAS?<\/span><\/strong> El que est\u00e9 fijado en el convenio colectivo aplicable o en su defecto el aplicable a su categor\u00eda profesional, sin que puede ser menor al salario m\u00ednimo interprofesional.<\/p>\n<p>7\u00ba)<strong><span style=\"color: #78be20;\"> \u00bfQU\u00c9 OCURRE CON LOS CONVENIOS COLECTIVOS QUE HAYAN ALCANZADO SU VIGENCIA?<\/span> <\/strong>Seguir\u00e1n vigentes mientras se negocie y firme uno nuevo.<\/p>\n<p>8\u00ba) <strong><span style=\"color: #78be20;\">\u00bf QU\u00c9 OCURRE SI TENGO CONVENIO DE EMPRESA?<\/span><\/strong> Prevalecer\u00e1 sobre el convenio salvo en lo relativo a salario y complementos.
